Welcome to Cramer Services. These Subscription Terms of Service (“Terms”) govern your enrollment in and use of our subscription plans (the “Services”). By subscribing to any Cramer Services plan, you (“Customer,” “you,” or “your”) agree to be bound by these Terms, which form a legally binding agreement between you and Cramer Services, LLC (“Cramer Services,” “we,” “us,” or “our”).
These Terms explain your rights and responsibilities as a subscriber, as well as our obligations in providing recurring maintenance, service, and benefits associated with your chosen plan. Please read them carefully before enrolling.
We may update or modify these Terms from time to time. If changes are made, we will provide notice by posting the revised Terms on our website and, where required, notifying you directly by email. Your continued subscription after such notice constitutes acceptance of the revised Terms.
Under this subscription, Cramer Services will provide one (1) full HVAC system tune-up per subscription term. The tune-up includes the following services:
In addition to the annual tune-up, subscribers receive:
Priority Service: Subscribers receive scheduling priority over non-subscribers when requesting service.
Service Credits: Subscribers earn a 5% credit for future repairs and installations performed by Cramer Services. Credits are automatically applied to the customer’s invoice and are not redeemable for cash.
Exclusions: Replacement parts (other than the included standard air filter) and repairs are not included in this subscription. Any additional parts or repair services identified during inspection will be quoted separately and billed to the customer.
Customers may select either a monthly billing option or an annual billing option at the time of enrollment:
Monthly Plan: Customers who choose the monthly plan will be billed $20 per month.
Annual Plan: Customers who choose the annual plan will be billed once per year at a discounted rate equal to 5% off the total monthly cost.
An onboarding fee of $125 will be charged at the start of the subscription unless the customer has received an AC Tune-Up, Furnace Tune-Up, or Full HVAC Tune-Up from Cramer Services within the past three (3) months. In that case, the onboarding fee is waived.
Payments will be processed automatically using the payment method provided at enrollment.
Monthly subscribers are billed every month on the same date as their initial payment.
Annual subscribers are billed once per year on the anniversary of their initial payment.
Subscriptions automatically renew unless canceled in accordance with the Cancellation & Refund Policy outlined in these Terms.
Customers may cancel their subscription at any time by contacting Cramer Services by phone or email.
No Refunds: All payments made are non-refundable.
Service Through Billing Period: Upon cancellation, the subscription will remain active through the end of the customer’s current billing period. Services and benefits will continue to be available until that time, after which the subscription will not renew and billing will stop.
With each subscription payment, customers automatically earn credits equal to the percentage benefit of their plan.
Automatic Application: Credits are added to the customer’s account after each successful subscription payment.
Use of Credits: Credits may be redeemed toward the cost of future repairs and installations performed by Cramer Services.
Limitations: Credits cannot be redeemed for cash, applied to past balances, or transferred to another individual or account.
To ensure safe and effective service, subscribers agree to the following responsibilities:
Accurate Information: Customers must provide complete and accurate information when enrolling in the subscription, including contact details, service address, and payment information. Customers are responsible for updating Cramer Services with any changes.
Access to Property: Customers must provide safe and reasonable access to the service location at scheduled times, including access to HVAC units and related equipment.
Safe Work Environment: Customers are responsible for maintaining a safe environment free of hazards that could interfere with service or place technicians at risk.
Equipment Condition: Customers must maintain their equipment in a condition that allows for proper inspection, cleaning, and servicing. Any pre-existing issues that prevent completion of service must be resolved by the customer at their own cost.
Compliance with Recommendations: Customers are responsible for following reasonable recommendations provided by Cramer Services technicians to ensure the safe and efficient operation of HVAC equipment.
Cramer Services provides the subscription plan and related services on an “as-is” basis with no warranties of any kind, whether express or implied. This means that:
No guarantees are made regarding system performance, efficiency, or outcomes of the tune-up beyond the specific services listed in these Terms.
The subscription does not include warranties for HVAC equipment, replacement parts, or future repairs.
Any manufacturer warranties on parts or equipment remain the responsibility of the manufacturer and are not covered by this subscription.
Cramer Services is not responsible for any pre-existing issues with equipment, including but not limited to defects, damage, poor installation, or lack of prior maintenance.
To the fullest extent permitted by law, Cramer Services disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the fullest extent permitted by law, Cramer Services, LLC and its employees, contractors, and representatives shall not be held liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the subscription, including but not limited to loss of use, loss of revenue, or damage to property.
Cramer Services’ total liability for any claim related to this subscription shall not exceed the amount paid by the customer for the subscription during the twelve (12) months preceding the event giving rise to the claim.
Cramer Services is not liable for delays or failure to perform services due to circumstances beyond our reasonable control, including but not limited to equipment failure, unavailability of parts, inclement weather, or customer’s failure to provide safe and timely access to equipment.
Cramer Services reserves the right to suspend or terminate a customer’s subscription at any time if:
Payment is not received when due,
The customer fails to comply with these Terms,
The customer provides false or misleading information, or
Service cannot be safely performed due to hazardous conditions at the customer’s property.
If a subscription is terminated by Cramer Services for non-compliance or non-payment, no refunds will be issued.
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located within Missouri, and both parties consent to such jurisdiction and venue.
